The Scare Factor Casting / Modeling General Release Form and Assumption of Risk

I, the undersigned, am participating as an actor, model, or other crew member in the project ‘Paranormal Investigation and Video Shoot’ at the ‘Location’ listed below (hereinafter the “Project”).

This General Release Form & Assumption of Risk covers the entirety of my participation in the Project, including travel to and from the Project, as well as participation including travel to and from any off-site marketing and promotional events for the Project.   

I acknowledge and appreciate that becoming an actor, model, or other crew member on the Project requires a moderate level of physical activity and that certain risks are inherent in participating in these activities. These risks include but are not limited to, personal injury, illness or death, property damages, and property loss or theft. The risks may arise out of accidents or other circumstances, including, but again not limited to, the negligent acts or omissions of myself or others (including The Scare Factor, LLC, its owners, employees, volunteers, or agents).

I hereby grant The Scare Factor, LLC, and those acting under its authority, including Thrifty13, Inc. and Proffet Properties, LLC, the right (but not the obligation), in perpetuity throughout the world, in all media, now or hereafter known, to use (in any matter it deems appropriate and without limitation) in and in connection with the Project or any documentaries or marketing materials, as well as a license to film and take photographs of me in connection with the Project or any subsequent or future films or documentaries and to use my name, image, and likeness in all forms and media for all lawful purposes including, but not limited to, the Project and internal and external The Scare Factor, LLC communications. I understand that I will not own any rights to the Project or any documentary and I waive any opportunity and/or right to inspect or approve the Project or the use of my name, image, and likeness in the manner stated above.

I HEREBY RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS THE SCARE FACTOR, LLC, PROFFET PROPERTIES, LLC, THRIFTY13, INC., ITS AFFILIATES, PREDECESSORS, SUCCESSORS, TRUSTEES, OFFICERS, DIRECTORS, FACULTY, EMPLOYEES, AGENTS, AND REPRESENTATIVES, PAST OR PRESENT (THE “RELEASED PARTIES”) FROM ANY AND ALL CLAIMS, SUITS, LIABILITY, JUDGMENTS, COSTS, AND EXPENSES (“CLAIMS”) FOR ANY PERSONAL INJURY OR ILLNESS, EPIDEMICS AND DISEASE, DEATH, PROPERTY DAMAGE, LOSS AND/OR THEFT, ARISING OUT OF ANY ACCIDENT, CIVIL DISTURBANCE OR DISORDER, ACT OF TERRORISM, OR ANY OTHER OCCURRENCE DURING THE PROJECT OR WHILE I AM TRAVELING TO OR FROM THE PROJECT; AND FROM ANY CLAIMS ARISING FROM OR RELATED TO THE MAKING OF THE PROJECT, THE POST-PRODUCTION USES OF THE PROJECT, OR THE USE OF MY NAME, IMAGE, VOICE, MUSIC SUNG OR PLAYED BY ME, MY ACTUAL OR FICTITIOUS NAME, OR LIKENESS IN CONNECTION WITH THE PROJECT OR AS OTHERWISE DETAILED ABOVE. I ALSO AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FROM AND AGAINST ANY, AND MY OWN ACTS OR OMISSIONS DURING OR RELATED TO THE PROJECT, INCLUDING MY TRAVEL TO OR FROM THE PROJECT.
